TERMS OF SERVICE

These Terms of Service (“Terms”) govern your access to and use of the Ace Made online store and any related sites or checkout pages (the “Store”). The Store is operated by Asencion Asplund, doing business as Ace Made (“Ace Made,” “we,” “us,” or “our”), located at 510 N 4th St, Watseka, IL 60970. Contact: [email protected].

By browsing, creating an order, or completing a purchase, you agree to these Terms. If you do not agree, do not use the Store.

1. Eligibility

You must be at least 18 years old to place an order. By ordering, you represent that you meet this requirement and that the information you provide is accurate.

2. Products and print-on-demand

Ace Made sells apparel and merchandise that may be produced print-on-demand through third-party fulfillment partners (including Printify and their print providers). Product photos and mockups are illustrative. Colors, placement, scale, and fabric texture can vary from what you see on screen because of device displays, garment blanks, ink, and production differences. That variance is normal for print-on-demand and is not, by itself, a defect.

3. Orders, pricing, and payment

Prices, taxes (if applicable), and shipping estimates are shown at checkout. Placing an order is an offer to buy. We may decline or cancel an order for suspected fraud, pricing/error issues, stock or print failures, or fulfillment problems. If we cancel after payment, we will refund the amount paid for the canceled items through the original payment method (or otherwise as required by the payment processor), except where an exchange/reprint path applies under our Refund & Exchange Policy.

Payments are processed by Stripe on its secure checkout page. We do not see or store your full card number. Your payment is also subject to Stripe’s terms.

4. Intellectual property

All Ace Made artwork, designs, logos, text, and store branding are owned by us or our licensors. Buying a product gives you ownership of that physical item only. You do not receive any right to copy, reproduce, commercially reprint, or create derivative products from our designs.

5. Acceptable use

You agree not to misuse the Store, attempt unauthorized access, interfere with checkout or fulfillment, or submit fraudulent orders or chargebacks without a good-faith basis.

6. Disclaimers

THE STORE AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” TO THE FULLEST EXTENT PERMITTED BY LAW. WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, EXCEPT WHERE SUCH DISCLAIMERS ARE NOT ALLOWED. We do not guarantee uninterrupted access, exact color match to mockups, or delivery by a specific date.

7. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ACE MADE AND ASENCION ASPLUND WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO AN ORDER WILL NOT EXCEED THE AMOUNT YOU PAID FOR THAT ORDER.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum extent permitted.

8. Indemnity

You agree to defend and hold us harmless from claims arising out of your misuse of the Store, your violation of these Terms, or your infringement of someone else’s rights, to the extent allowed by law.

9. Privacy

Our collection and use of personal information is described in our Privacy Policy. Shipping is limited as described in our Shipping Policy. Refunds and exchanges are governed by our Refund & Exchange Policy.

10. Changes

We may update these Terms by posting a revised version with a new “Last updated” date. Continued use of the Store after changes means you accept the updated Terms.

11. Governing law

These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law rules. Courts in Illinois will have exclusive jurisdiction, except where applicable law requires otherwise.
